Abilities Unlimited Australia (AUA) Service Agreement

Conditions of AUA Participation:

  • AUA participants must be between the ages of 3 and 17 years of age.

  • All participants must be actively supervised by either a parent or carer, whilst participating in any AUA programs and/or in attendance at any AUA venue.

  • Active supervision means the parent or carer is within sight and hearing of the participant whilst they are participating in an AUA program or in attendance at any AUA venue. Exceptions may be made on a case-by-case basis following a risk assessment and as agreed to by both parties.

  • All parents or carers are responsible for duty of care of their respective participants throughout all AUA programs and sessions.

  • All participants must be checked in at the registration desk at the commencement of each session.

  • Inappropriate physical or verbal behaviour, or otherwise may result in removal from the AUA program and AUA program venue.

  • Glass or other breakable objects must not be brought onto the premises.

  • Animals and pets are not allowed on the premises of any AUA venues.

  • Personal property should not be left unattended. AUA accepts no liability for any loss or damage to your personal property on program location premises.

  • AUA is smoke, drug and alcohol-free.

  • AUA employees and volunteers will be treated with courtesy and respect, at all times.

Safety

  • The use of appropriate, and properly fitted equipment is mandatory in order to reduce the risk of injuries. Participants and parents/carers participating with their child must wear the required safety equipment and appropriate clothing during programs.

  • An Australian Standards approved helmet and enclosed shoes are required for all cycling programs.

  • An Australian Standards approved helmet, wrist pads and enclosed shoes are required for all skateboarding programs.

  • Participants who are not yet toilet trained, must wear a suitable, leak-proof swim nappy while swimming (water programs).

  • Jewellery and lose fitting clothes can be a hazard and should not be worn during programs.

  • AUA is not liable if an accident or injury is to occur due to failure to use appropriate equipment.

  • All safety signage within each program, are to be followed. Specific rules include:

    o   No Diving (water programs)

    o   No Running (water programs)

Instructors and Session Time Changes

  • While AUA strives to provide each participant with a consistent instructor, at times this may not possible due to unavoidable circumstances. Make up sessions or refunds will not be granted if there is an instructor change.

Service Provision and Delivery

  • All AUA programs will follow AUA’s approved program framework.

  • AUA’s programs are delivered utilising targeted support. Support needs are based on the program and individual needs.  AUA will always strive to provide required intensive support when needed.  

  • AUA programs operate out of multiple venues. By registering in an AUA program you acknowledge and accept that specific location details will be provided, and you are aware of the necessary location.

  • By registering in an AUA program, you are confirming that you visited AUA program pages and understand how the service of the program will be delivered.

  • By registering in an AUA program, you are agreeing to the terms of this Service Agreement for the duration of the program you have registered for.

  • The terms of this Service Agreement are reviewed by the AUA executive team each term and will be updated accordingly. If an update is made, you will be made aware in writing two weeks before the commencement date of the Service Agreement.

Medical

  • In registering for an AUA program, you are confirming the participant has no medical condition that may affect their ability to participate in sessions. If the participant does have such a medical condition, medical clearance is required to be provided.

  • In registering for an AUA program, you are confirming that you consent to the participant receiving appropriate medical treatment in case of an emergency through AUA staff or Emergency Services personnel.

  • Should the participant or the parent/carer have, or develop, any known or suspected contagious medical condition, they should not attend programs. For the safety and wellbeing of participants and families, the unwell person should be clear of all symptoms for at least 24 hours before attending a program.

Program Fees

  • I accept that the fees being charged by AUA are reasonable for the services provided.

  • AUA programs can only be booked for one whole term in advance. Once registered for a specific program, it is your responsibility to ensure that payment is made within 14 days of the invoice date.

  • If payment is not received by the invoice due date a $20 late fee may will be incurred.

    Program Cancellation

  • If you wish to cancel a program, you can do so by emailing info@abilitiesunlimited.com.au

  • If a cancellation of a program occurs, no refunds or credits will be provided for sessions already passed.

  • A cancellation of a program will not be processed until payment for the completed sessions has been received, or proof of payment has been been provided to AUA.

  • If you fail to attend 3 consecutive programs without prior notice provided to AUA on info@abilitiesunlimited.com.au your registration will be cancelled and payment for the total number of sessions completed will be due.

Attendance

  • AUA Programs are currently delivered at Evatt Primary School, Cranleigh School, Black Mountain School and Mt Stromlo Forrest Park, all which are in the Australian Capital Territory. Program confirmation will identify the required venue for attendance.

  • AUA has a long wait list for some programs and therefore,  if you cancel or do not attend for three consecutive sessions, we may forfeit your enrolment placement.

  • No refunds will be given for cancelled or non-attended sessions as spaces are reserved for as long as you are enrolled, there are no refunds for any classes missed.

  • Program credits given at AUA’s discretion will be valid for twelve (12) months from the cancellation date.

Rebooking

  • AUA have long wait lists for some programs and therefore, families will be requested to confirm by week 4 of current term if they wish to continue with programs for the following term. A confirmed placement may be held for one week for confirmation. If confirmation is not received, the space will be opened to another family.

Program Continuity

  • AUA has systems and processes in place to support you during service disruptions.

  • In the event of heavy rain or other inclement weather outside of our control, our ability to deliver services may be impacted.

  • In these circumstances, we will do our best to provide an alternative to cancelling, however the safety of participants and families is integral, and cancelling is sometimes the only option

  • If AUA is required to cancel programs, parents/carers will be advised via our Facebook page by 8am on the morning of the session. Term fee will not be reduced due to weather cancelations.

Data Protection Policy

  • AUA will not knowingly make available any personal information that we hold about you to any person(s) not directly responsible for or connected with the servicing of the program. Any information collected will be stored and protected under AUA privacy policies and procedures.

Feedback, Concerns, and Disputes

  • If you would like to provide feedback or are not happy with the provision of programs and wish to make a complaint, please contact AUA by emailing:  manager@abilitiesunlimited.com.au

Social Participation

  • Family engagement and social participation is an important element of the organisation. You understand that AUA is a not-for-profit community organisation led by a volunteer board. A member’s family or support network is encouraged and invited to volunteer and support within and outside of AUA and their programs.
